Defendant was charged with two counts of making a false writing under K.S.A. 21-3711. A district magistrate Judge found the evidence submitted at preliminary examination to be sufficient to establish the crimes charged under K.S.A. 21-3711. The defendant filed a motion to dismiss based upon a failure by the State to produce evidence showing intent to induce official action. See K.S.A. 22-3208. The district judge granted the motion. The State appeals, claiming the district judge erred in finding that the State had failed to produce sufficient evidence at the preliminary examination to establish that the crimes of making a false writing had been committed.
